General Terms of Use and Sale - Aura

These General Terms of Use and Sale ("GTU/GTS" or the "Agreement") govern your use of Aura, including the Aura mobile application, the website https://www.auraapp.fr and all related features (together, the "Services").
By accessing or using the Services, you agree to be bound by these GTU/GTS and all applicable laws. If you do not accept these terms, you must not use the Services.
This Agreement is entered into between:

and the end user ("you" or the "User").
1. Services Overview & Definitions
1.1 Overview
Aura is a digital fashion platform offering:
- digitization and organization of your wardrobe through artificial-intelligence image recognition;
- automatic generation of styled outfits adapted to your wardrobe, weather and occasions;
- AI-assisted styling tools (virtual mannequins, recommendations).
1.2 Definitions
- "Application": the Aura mobile application available on iOS through the App Store, and which may also be offered on Android according to the distribution methods decided by the Publisher.
- "Site": the website https://www.auraapp.fr.
- "Subscription Plans": paid Plus and Pro subscriptions, billed monthly.
- "In-App Purchase (IAP)": purchases made within the Application through the Apple App Store payment system.
- "Aura Boost": an additional generation pack purchasable through Apple IAP.
- "Digital Content": outfit images, descriptions, recommendations and other AI-generated content for the User.
1.3 Changes to the Agreement
We may modify these GTU/GTS. Any substantial change will be communicated to you by notification in the Application and/or by email with reasonable notice. Continued use of the Services after notification constitutes acceptance of the new version.
2. Eligibility Conditions & Age
2.1 Minimum age
- You must be at least 15 years old to use the Services (Article 8 GDPR, Article 7-1 French Data Protection Act).
- You must be 18 years old (or of legal age in your country of residence) to subscribe to a paid subscription or make a purchase.
2.2 Parental consent
Users aged 15 to 17 must obtain the consent of a person holding parental authority to subscribe to a subscription.
2.3 Prohibited conduct
In particular, it is prohibited to:
- impersonate another person;
- publish or upload unlawful, harmful, obscene or misleading content;
- attempt to alter, circumvent or reverse-engineer the technical mechanisms of the Application;
- use the Services for unlawful activities;
- access the Services by unauthorized automated means (scrapers, bots);
- share your account with third parties for commercial purposes.
3. Account Creation
You must create an account to access all features. You agree to:
- provide accurate and up-to-date information;
- keep your login credentials confidential;
- notify us without delay of any unauthorized access to your account (privacy@auraapp.fr).
We reserve the right to suspend or terminate an account in the event of fraud, serious breach of these GTU/GTS, or legal risk to Aura or its users.
4. Subscription Plans & Purchases
4.1 Free trial (Free)
Each new user benefits free of charge, on a trial basis, from a limited monthly quota of digital content generations. The exact quotas are indicated in the Application and may change. The free version does not require any payment method.
4.2 Plus
- Price: 4.99 € per month, automatic monthly renewal.
- Includes an expanded monthly quota of clothing item scans and classic outfit generations, as well as a limited number of premium generations.
- The precise quantities are indicated in the Application at the time of subscription. Quotas may be adjusted; any substantial change will be notified to you in advance.
4.3 Pro
- Price: 9.99 € per month, automatic monthly renewal.
- Includes an extended monthly quota of scans and outfit generations, with priority access to premium generations and advanced personalization.
- The precise quantities are indicated in the Application at the time of subscription.
4.4 Aura Boost (In-App Purchase)
- Price: 0.99 € per pack, one-time purchase without renewal.
- Allows you to obtain additional generations in addition to your subscription (or without a subscription).
- The exact quantities included in each pack are indicated in the Application at the time of purchase and may change.
- Sold exclusively through Apple In-App Purchase.
4.5 Validity of quotas
Monthly digital content generation quotas are reset at the beginning of each billing period. Unused generations are neither carried over nor accumulated.
Generations purchased through Aura Boost are added to the quota and remain valid until used, without expiration.
5. Purchases & Payment Methods
5.1 In-App Purchases (Apple)
Any purchase made in the iOS Application (subscriptions and Aura Boost) is processed through Apple's payment system. These transactions are subject to the Apple Inc. terms and conditions. Aura does not have access to any User banking data.
5.2 Purchases on the Website
Plus and Pro subscriptions may also be purchased on https://www.auraapp.fr through Stripe, a PCI-DSS Level 1 certified payment provider. Accepted payment methods include bank cards (Visa, Mastercard, American Express) as well as Apple Pay and Google Pay where available.
5.3 Price difference
In accordance with Apple's rules, prices displayed in the Application may differ slightly from prices displayed on the Site (in particular due to currency conversions and Apple's commission). The Application does not redirect the User to the Site for the purpose of avoiding Apple's payment system.
6. Renewal & Termination
6.1 Automatic renewal
Plus and Pro subscriptions automatically renew at each monthly period, unless canceled at least 24 hours before the renewal date.
6.2 Renewal notice
In accordance with Article L.215-1 of the French Consumer Code, for any fixed-term subscription with tacit renewal, we will inform you in writing (by email) no earlier than three months and no later than one month before the end of the period allowing rejection of the renewal. This obligation applies to annual subscriptions when we offer them.
6.3 Termination
You may cancel your subscription at any time:
- For Apple IAP subscriptions: through your Apple ID Settings (Settings -> Your name -> Subscriptions).
- For Web subscriptions (Stripe): from your account on https://www.auraapp.fr or by writing to privacy@auraapp.fr.
Termination takes effect at the end of the current billing period. You retain access to paid features until that date. No pro rata refund will be made for the period already started, except in cases provided by law (see sections 7 and 8).
7. European Right of Withdrawal (14 days)
In accordance with European Directive 2011/83/EU and Articles L.221-18 et seq. of the French Consumer Code, consumers residing in the European Union have a 14-day period from subscription to withdraw, unless expressly waived.
7.1 Withdrawal before use
If you have not used any generation included in your subscription (no scan, no outfit generation), you may request a full refund within 14 days by writing to privacy@auraapp.fr.
7.2 Waiver of the right of withdrawal
Important: as soon as you start using the generations included in your subscription, you waive your right of withdrawal, in accordance with Article L.221-28, 13° of the French Consumer Code.
Before any subscription, you must expressly confirm:
- your wish to access the digital content immediately; and
- the loss of your right of withdrawal from the first use.
8. Refund Policy
8.1 Unused subscription
Full refund within 14 days following subscription, provided that no generation has been used.
8.2 Started subscription
After the first use, no refund is due. As a commercial gesture and on a case-by-case basis, we may offer a refund pro rata for unused days.
8.3 Aura Boost
Aura Boost packs are not refundable once purchased, except as required by mandatory applicable law.
8.4 Apple purchases
Refunds related to In-App Purchases (subscriptions and Aura Boost purchased through the App Store) are handled exclusively by Apple. To request a refund, contact Apple through https://reportaproblem.apple.com.
8.5 Excluded cases
No refund will be granted in the event of fraud, refund abuse (chargeback), or serious breach of these GTU/GTS.
9. Intellectual Property & Generated Content
9.1 Aura rights
All elements of Aura (algorithms, design, software, AI prompts, database) are the exclusive property of Tobiasz Bajek (Bajek Dev Paris) or third-party rights holders. Any unauthorized reproduction is prohibited.
9.2 AI-generated content for the User
Images, descriptions and outfits generated specifically from your wardrobe are made available to you under a personal, worldwide, non-transferable license reserved for personal and non-commercial use. You may:
- view, save and share this content privately;
- use it on your own social networks for personal purposes.
You may not:
- resell this content;
- use it for commercial purposes without Aura's prior written consent;
- use it to train other AI models.
9.3 Photos uploaded by the User
You retain full ownership of the photos of clothing items that you upload. By uploading them, you grant Aura a non-exclusive, worldwide, free and revocable license to:
- host these photos on our servers;
- transmit them to our technical processors (Google, OpenAI) solely for the purpose of generating descriptions, metadata and outfits;
- display them in your user interface.
This license automatically ends when you delete the content or your account, except for legal retention obligations.
9.4 No training on your content
Aura does not use your photos or personal data to train or fine-tune its AI models. Our processors (Google, OpenAI) are contractually committed not to use data sent by Aura for training purposes.
9.5 No facial recognition
Aura does not generate avatars representing real persons. No biometric processing is performed.
9.6 Reporting illegal content
Aura provides all users with a mechanism for reporting illegal content, accessible and usable at all times, in accordance with Article 16 of the DSA and Article 6, IV of the LCEN.
Any user who identifies content on the Services that they consider illegal is invited to report it to Aura by email at privacy@auraapp.fr (subject: "Illegal content report"), providing the information necessary to identify the content and justify the report, in accordance with the procedures detailed in our Legal Notice.
Aura will acknowledge receipt of the report and inform the reporting person of the decision taken, as well as the available remedies.
It is recalled that submitting a manifestly unfounded report constitutes misuse of the mechanism and may engage the liability of its author.
10. Personal Data Protection
The processing of your personal data is governed by our Privacy Policy, compliant with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and the French Data Protection Act of January 6, 1978, as amended.

11. Limitation of Liability
Within the limits permitted by French law:
Aura makes every effort to ensure the accuracy and updating of the information published. However, the User acknowledges that Aura is provided "as is" and that its use is under the User's sole responsibility.
Aura may only be held liable for direct and foreseeable damages resulting from a proven breach of its contractual obligations.
Aura shall not be liable for indirect damages such as loss of data, loss of revenue, business interruption, damage to reputation or any other intangible loss.
In the event of a proven breach by Aura of its contractual obligations, Aura's total liability is limited to the amount of sums actually paid by the User during the 12 months preceding the event giving rise to the damage.
No provision of these GTU/GTS limits the mandatory consumer rights provided by French and European law.
12. Suspension & Termination
12.1 Termination by Aura
We may suspend or terminate your account without notice in the event of:
- serious or repeated breach of these GTU/GTS;
- infringement of third-party rights (intellectual property, privacy);
- fraud, refund abuse (chargeback) or illegal activity;
- non-payment of amounts due;
- use of the Services for purposes manifestly contrary to their intended purpose.
12.2 Termination by the User
You may delete your account at any time:
- from the Application (Profile -> Delete my account);
- by writing to privacy@auraapp.fr.
Account deletion results in deletion of your data within 30 days, except for legal retention obligations (in particular accounting obligations).
13. Governing Law & Disputes
13.1 Governing law
These GTU/GTS are governed by French law.
13.2 Mediation and dispute resolution
In the event of a dispute, we invite you to contact us first at the following address: privacy@auraapp.fr.
Failing prior amicable resolution, the consumer may use, free of charge, the consumer mediator to which the Publisher is subject, in accordance with the provisions of the French Consumer Code.
The contact details of the competent consumer mediator will be communicated to the consumer upon simple request or will appear on the website and/or in these Terms once a mediator has been appointed by the Publisher.
13.3 Competent jurisdiction
Failing amicable settlement, any dispute will fall within the jurisdiction of the courts of the Paris district, subject to the mandatory rules protecting consumers residing in the European Union.
14. Language Versions
These GTU/GTS are available in French and English. For users residing in France, the French version prevails in the event of any divergence of interpretation.
